Va. man settling lawsuits in W.Va. festival death

MORGANTOWN, W.Va. (AP) -- A Virginia driver who crashed into a tent at a West Virginia music festival wants to settle three wrongful death and personal injury lawsuits.

Documents filed in U.S. District Court in Clarksburg last week show Clay Lewin's insurer would pay the father of Nicole Miller $300,000. The 20-year-old South Carolina woman died last July in West Virginia, while two friends were severely injured at the All Good Music Festival near Masontown.

Multiple lawsuits have been filed by the victims against the driver, Clay Lewin of Cape Charles, Va. Survivors Yen Ton and Elizabeth Doran would get $100,000 apiece.

Their demands ranged from $975,000 to $13.5 million. But Lewin's policy with Virginia Farm Bureau Mutual Insurance limits payments to $300,000 per person and $500,000 per accident.

Lewin, of Cape Charles, is among more than a dozen defendants, including organizers, producers, promoters and corporations who were sued.

The settlement requires court approval.
