Unstable Skechers Toning Shoes Allegedly Cause Ankle Fracture

According to court documents, the plaintiff bought Skechers Shape-Ups in December 2009 and wore them during her day-to-day activities. After wearing Shape-Ups daily for about eight months, the plaintiff was walking down stairs when her right toning shoe turned inwards, buckling her right ankle and causing her to fall down. The immediate and intense pain in her right ankle led the plaintiff to seek immediate medical treatment, after which she was informed that she had fractured her right ankle (specifically, her lateral malleolus). The severity of the ankle fracture required emergency surgery to implant screws and a metal plate into the right ankle. While the plaintiff was ordered to not put any weight on her right ankle for six week, she also had to attend months of physical therapy sessions in an effort to treat her serious Skechers injury.

Intentionally Misleading Skechers Claims

While Skechers ads touted the many health benefits that their Shape-Ups offered consumers, an independent study overseen by the American Council on Exercise (ACE) at the University of Wisconsin found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [ http://www.acefitness.org/getfit/studies/toningshoes072010.pdf"http://www.acefitness.org/getfit/studies/toningshoes072010.pdf

In May 2012, Skechers was ordered to pay the Federal Trade Commission $40 million to settle FTC charges after the courts agreed with such findings of Skechers negligence by ruling that Skechers had overstated the health benefits of Shape-Ups.
