Lawyer: Family upset with no charge in SC shooting

EUTAWVILLE, S.C. (AP) - The lawyer for the family of a man shot to death by Eutawville's police chief say they are disappointed that federal prosecutors will not pursue charges in the case.

Carl B. Grant told The Post and Courier that his investigation showed that Police Chief Ricky Combs was saying racial epithets to 54-year-old Bernard Bailey when he shot him outside Eutawville Town Hall in May 2011.

Grant says federal prosecutors decided not to prosecute Combs for violating Bailey's civil rights. He says any fair-minded person can smell the putrid, gut-wrenching smell of injustice when it enters the room.

State Solicitor David Pascoe is now doing his own review of the case.

Authorities say Combs shot Bailey because he was trapped by Bailey's truck after a confrontation.
