CHARLESTON, S.C. (WCIV) -- The owners of the Osaka Japanese and Chinese restaurant on Folly Road are facing federal charges.
According to a federal indictment, Dao Ping Lin is charged with failure to truthfully collect and pay over withholding taxes. He is also charged with employing unauthorized aliens.
During the end of 2010, according to the indictment, Lin was supposed to deduct federal income taxes from his employees' pay and make payments to the Internal Revenue Service.
In January of 2011, Lin reportedly failed to account for those missing payments to the IRS.
As a result, the government is seizing a minimum of $399,619 as well as Lin's 2008 Infiniti. If the government doesn't get the money or vehicle, they can take possession of any of his other properties including his home and business.
The second charge accuses Lin of employing illegal aliens from October 2009 to February 2011.
