Jury finds for developer in AVX lawsuit

Posted: Updated:

CONWAY, S.C. (AP) - A state jury has awarded $750,000 in damages to a Myrtle Beach developer who sued AVX Corp. saying groundwater pollution by the electronics manufacturer derailed a condominium project.

The Sun News of Myrtle Beach reports the jury returned the verdict on Thursday.

The suit alleged groundwater contaminated with a chemical known as TCE hurt property values in a 10-block area near the company's former plant. JDS Development of Myrtle Beach contended the problem caused a bank to withdraw a construction loan for a condominium project.

The award includes $250,000 in punitive and $500,000 in actual damages.

An attorney with AVX said he will consult with company officials before deciding whether there will be an appeal.

AVX settled another lawsuit in 2011, and a class action lawsuit is pending.
