HARRISBURG, Pa. (WHTM) -
A Pennsylvania court will allow two state officials to continue their lawsuit that challenges where the NCAA can use the $60 million fine against Penn State University.
Commonwealth Court on Wednesday overruled the NCAA's preliminary
objections to the lawsuit filed by Treasurer Rob McCord and Senator Jake
Corman, a Republican whose district includes State College.
The NCAA, the governing body of collegiate athletics,
wanted the court to throw out the lawsuit McCord and Corman filed in
March to recover $12 million in penalties already paid by Penn State in the wake of the Jerry Sandusky child sexual abuse case.
The lawsuit argues that the NCAA must
deposit the entire $60 million penalty into an endowment fund for child
abuse prevention programs in Pennsylvania under a state law enacted
