CHARLESTON, S.C. (WCIV) -- Charleston police responded to a home on Clark Sound Drive Sunday after reports of a man threatening an ice cream truck driver who was selling treats to children.

According to police reports, the victim said she was selling ice cream near Bayview Farms Boulevard to a group of children when the suspect came out of his home with a 9mm pistol.

The victim said the suspect, 59-year-old Richard Lee Hill, pointed the gun at her and started to "yell obscenities" saying that soliciting was not allowed in the neighborhood.

Police found Hill sitting in his backyard and took him into custody. The report said he admitted taking his gun out but that he kept it pointed to the ground with ammunition in the clip but not the chamber.

Police say Hill was "apologetic" and called his actions "a dumb mistake."

Hill was charged with pointing and a firearm.
