Man who sued CCSO arrested for third time

CHARLESTON, S.C. (WCIV) -- A Charleston man who filed suit against the Charleston County Sheriff's Office for a beating he said he suffered at the hands of a deputy has been arrested for the third time, said officials with the Charleston Police Department.

According to a police report, Devante Pittman, 20, was being questioned about a reported  burglary at his home on Acacia Street, when he told detectives he had purchased a handgun two months ago.

He told detectives the gun was at his home and he had been trying to sell it, the report states.

With written consent from Pittman, detectives retrieved the handgun from the home and determined the handgun was stolen from a North Charleston car break-in in July of 2012.

Officers said an armed man broke into Pittman's home on Sept. 19 and searched for money, while two juveniles were home alone.

In June, Pittman was arrested and charged with unlawful carry of a handgun inside a Citadel Mall store, according to a police report.

According to a separate police report, Pittman was arrested and charged in April with possession of a stolen vehicle, receiving stolen goods and second-degree battery and assault.

In a lawsuit filed in December of 2012, Pittman said deputies used excessive force on him after a November traffic stop.

According to the lawsuit, one of the deputies reached into the car and hit Pittman in the face numerous times with a metal flashlight.

Christopher Davis, a former deputy with the Charleston County Sheriff's Office, avoided conviction on the excessive force charge by agreeing to complete 50 hours of community service and provide a magistrate with a medical report.

Davis resigned in April.

Pittman received a $250,000 settlement in a civil lawsuit against the sheriff's office.

He is being held in the Al Cannon Detention Center.
