Gov. Haley drops extradition for Veronica's biological dad

OKLAHOMA CITY (AP/WCIV) -- South Carolina Gov. Nikki Haley is dropping her request to extradite the biological father of a Cherokee girl who was at the center of a bitter custody dispute. He could still face a charge of custodial interference.

"On behalf of the State of South Carolina, I think you for your cooperation in ensuring the laws and court orders of our states are respected and obeyed," Haley said in a memo to Oklahoma's governor.

Dusten Brown had been scheduled to appear Thursday in an Oklahoma county court to face extradition to South Carolina. Brown was charged in August with custodial interference for failing to hand over 4-year-old Veronica to her adoptive parents, Matt and Melanie Capobianco of James Island, S.C.

Brown's attorney said they would not be in court on Thursday now that there is no reason for a hearing with the extradition order dropped.

"We are pleased that Governor Haley has withdrawn her request for extradition and see this as a step in the right direction for all involved," said Cherokee Nation Attorney General Todd Hembree.

Oklahoma Gov. Mary Fallin withdrew the extradition order after hearing from Haley and said she hoped that the case can be closed and both sides can move forward peacefully for Veronica's sake.

"My heart goes out to Dusten Brown as well as the Capobianco family. Both have suffered through a long and emotionally exhausting ordeal regarding a young girl they clearly love and wish the best for. I am thankful that Governor Haley has dropped her extradition request," Fallin said.

Brown last week handed over his daughter to the Capobiancos after the Oklahoma Supreme Court lifted an emergency stay that had kept Veronica in Oklahoma.

Brown of Nowata, Okla., could still face the charge if he ever goes to South Carolina.
