NORTH CHARLESTON, S.C. (WCIV) -- The man who sued the Charleston County Sheriff's Office for excessive force is behind bars again for failing to appear in court.

According to court records, a bench warrant was issued for Devante Pittman on October 8 after he failed to appear in court.

Pittman faces charges of unlawful carrying of a firearm, possession of a stolen vehicle and assault and battery in the second degree.

The original charges stem from an incident in June when Pittman was arrested for having a gun inside a Citadel Mall store. The other charges are from an incident in April.

On Friday, North Charleston police report they pulled Pittman over for having a broken brake light. Once they ran his name, they saw the open bench warrants for failure to appear and took him into custody.

In a lawsuit filed in December of 2012, Pittman said deputies used excessive force on him after a November traffic stop.

According to the lawsuit, one of the deputies reached into the car and hit Pittman in the face numerous times with a metal flashlight.

Christopher Davis, a former deputy with the Charleston County Sheriff's Office, avoided conviction on the excessive force charge by agreeing to complete 50 hours of community service and provide a magistrate with a medical report.

Davis resigned in April.

Pittman received a $250,000 settlement in a civil lawsuit against the sheriff's office.
